Terms of service

1. Introduction

These terms establish the contractual agreement between Kimochi Kardz and the buyer, applying to all purchases made through this website. These terms take precedence over any other conditions unless expressly approved by Kimochi Kardz. We retain the right to modify these terms at any time. By accessing or using our website, you agree to comply with these terms.

2. Account Registration

To make purchases, you need to create an account. By creating an account, you confirm that you have read and accepted the terms of service. You are responsible for maintaining the confidentiality of your account information and all activities under your account.

3. Goods and Services

The goods and services available are those displayed on the product page, subject to stock availability. Each item has a supplier-provided description in the advertisement. Product photographs may not perfectly match the item offered.

4. Prices

All prices shown in the advertisements are in Euros and include the standard VAT rate applicable in Luxembourg. Buyers must pay the prices specified at the time of purchase. Kimochi Kardz reserves the right to modify prices at its discretion, with any adjustments taking effect immediately and prior notice. 

5. Shipping and Delivery

The online sale of products and services is restricted to buyers residing in Europe. Currently, no shipping shipping options are available; purchases are only available for pick-up at the designated address.

6. Orders 

To purchase a product or service, the buyer must:

a. Fulfill payment obligations as specified.
b. Review and confirm their order and payment. By confirming the order, the buyer agrees to the sales terms, acknowledges complete understanding, and waives any claim to their own purchase conditions or other terms. All information provided and the confirmed order will serve as transaction evidence. Confirmation indicates acceptance of the transaction. The seller will send an email confirming the registered order.

7. Withdrawal

Non-professional buyers are entitled to a fourteen-day withdrawal period starting from the reception of their order. During this period, they may return the product to Kimochi Kardz for an exchange or refund, excluding return shipping costs. To exercise the right of withdrawal, the consumer must email Kimochi Kardz at kimochikardz@gmail.com within 14 calendar days. Single cards and opened products are excluded. Refunds will be issued to the original payment method used for the purchase after all products are returned and checked. Refund processing times may vary.

8. Payment

We accept various payment methods, including credit/debit cards and wire transfers. The available payment methods will be displayed during checkout. Depending on the chosen payment method, additional fees may apply. By providing your payment information, you authorize us to charge the specified amount for your order. All prices and transactions are in Euros. Currency conversion fees may apply if your payment method uses a different currency. Upon successful payment authorization, you will receive an order confirmation email. In case of a payment dispute or unauthorized charges, contact our customer support team immediately. If a payment attempt fails, your order may be delayed or canceled.

9. Preorders

Preorders are accepted based on availability and subject to confirmation. Payment is required at the time of preorder unless otherwise specified. Preorders are final and cannot be modified or canceled, except in the event of a price increase. You will have the option to proceed with the preorder at the new price or cancel for a refund. If a preorder is cancelled or cannot be fulfilled, Kimochi Kardz cannot be held liable. We will notify you and provide options for alternatives or refunds. Release dates are estimates and subject to change. Preorder items will be available for pick-up at the designated address once available.  

10. GDPR Data Protection

All personal information submitted will be handled in compliance with GDPR regulations. Kimochi Kardz shares personal data with payment processors and shipping services to ensure proper order processing. Digital records maintained by Kimochi Kardz serve as evidence of communications, orders, payments, and transactions.  

11. Liability

Kimochi Kardz is not responsible for indirect damages such as loss of revenue or harm to third parties, defects arising from the buyer's or a third party's actions, or damages from improper usage of purchased products. The buyer acknowledges that Kimochi Kardz does not guarantee product compliance with regulations beyond those applicable in Luxembourg at the time of delivery. Kimochi Kardz cannot be held liable for subsequent legal changes.

12. Intellectual Property 

All parts of the website are protected by copyright. Written permission is required from Kimochi Kardz for their use.  

13. Litigation

These terms are governed by Luxembourgish law. In the event of a dispute, jurisdiction is assigned to the competent courts of Luxembourg, regardless of the presence of multiple defendants or warranty claims.
